The dense bureaucracies that are the United States Citizenship and Immigration Service (USCIS), the United States Department of State (USDOS), the United States Department of Labor (USDOL), the United States Customs and Border Patrol (USCBP) and the Immigration and Customs Enforcement Agency (ICE) present a challenge to foreign nationals and employers desiring to successfully navigate applications through them. A nonimmigrant or temporary visa allows an individual to be in the U.S. for a finite period of time. Each temporary or nonimmigrant visa has specific requirements that must be met in order for an individual to qualify for the visa. For example, a work visa like the H-1B visa requires employer sponsorship. A student visa permits an individual to attend a U.S. college or university. A tourist visa allows an individual to visit the U.S., but not study or work. It is important to understand visa requirements when determining visa eligibility. Employers may not know what type of visa is required for a particular candidate or whether a candidate possesses the appropriate documentation for employment. Typically, the recruiter finds out either before, during or (in worst case) after the hiring process is completed that a foreign national needs immigration assistance. Change of Status Petition/Application - While someone is physically present in the U.S. in a valid nonimmigrant status (such as B-1/B-2), a petition may be filed with the USCIS requesting another status (i.e., H-1B). Once the petition is approved, the effective date of the approval notice is the date the individual’s visa status changes to the new status. Extension of Stay Petition/Application - While someone is physically present in the U.S. in valid nonimmigrant status, a petition/application may be filed with the USCIS requesting an extension of stay. For nonimmigrant employment-based visa status, work authorization is automatically extended up to 240 days beyond the status expiration date, pending a decision on the petition/application. If the petition is denied, the individual’s status ends on the date the denial notice is issued. Petition filed with a request for Consular Notification - While an individual is physically outside of the U.S., a petition may be filed on his/her behalf with the USCIS. After the petition is approved, s/he may apply for and obtain a U.S. visa stamp at a U.S. consulate/embassy abroad. An individual’s immigration status does not become “effective” until the date s/he enters the U.S. with the U.S. visa.
