In international arbitration, the arbitrator may impose protective measures and temporary and is in competition with the state judge also competent.
The presence of an arbitration agreement does not deprive the parties of using the state judge especially when the urgency required and that the arbitral tribunal or is not formed or can not act effectively. (more…)

III. THE CASE OF FRENCH ON CONFLICT OF LAWS IS NOT UNIFIED
Apart from the application of international conventions, conflicts of law in Respect of Intercountry Adoption’s jurisprudence.
The first issue to be decided is whether in general whether to apply for intercountry adoption law of the adoptive or that of the adoptee. The difficulties subsequently, on the one hand, the possibility to treat a pronounced adoption abroad to a full adoption, even in cases where this type of adoption does not exist in the country of origin of ‘adopted and, secondly, the possibility of a decision in France adoption of a child whose personal status prohibits this institution.
