The schools of Islamic law (madhhab)

At the root of Islam, there were several schools of Islamic law (madhhab). These were known by their geographical location. There were for example, school Kufa (Iraq), Medina (Saudi Arabia), the school of Basra (Iraq) or that of Mecca (Saudi Arabia). But little by little, some teachers have been imposed and their followers and their literary works. Other schools have existed but not all survived to the present day. (more…)

The death penalty in classical Islamic law

The position of Muslims face the death penalty can be understood only in their conception of law.

1) Design Muslim law
Unlike the Roman conception that the law is “what the people prescribed and establishes” (Lex is quod populus iubet atque constituit), to quote the famous expression of the jurist Gaius (dv 180), the Islamic law of the idea that the law is decided by God and transmitted by his messengers to guide humanity. Each nation he sent a speaking its language. The Koran appoints 24, but said there were many others. Muhammad has come as the last prophet. God will judge each community based on its religious law. The death penalty in law Arabic tomorrow

Can we hope one day the abolition of the death penalty in the Arab-Muslim world? In response, we must analyse the debate doctrinaire bills and the various Arab-Muslim documents relating to human rights
1) The doctrine
The debate in the Arab-Muslim world around the death penalty is that the low response late one that takes place freely in the West. Indeed, the abolition of the death penalty raises the question whether it is possible to exclude the application of a standard expressly provided by the Koran.
Ziyad ‘Ali said that the question of abolishing the death penalty should be resolved in the light of social and religious values of each society and the intellectual level of civilization and its members. Thus, in a society where we kill little for the abolition of the death penalty would lead to disorder. (more…)

1) Keeping limited criminal Islamic standards
Most Arab countries have abandoned the sanctions Koranic opting for a system of sanctions taken mainly from the West. However, few countries that continue to use the so-called Islamic or sanctions are returned. Thus, Saudi Arabia continues to enforce sanctions against the Islamic offences such as theft, adultery, loss of life and physical integrity and apostasy, while Egypt has abandoned these sanctions.
